    not sure if you´re aware but Tecnicil have won an arbitration case, so getting money back isn´t that easy
    anyone on this forum who claims to have received money back is a liar – there have not been any deals

    Hi there. Let´s clear something up.
    Tecnicil haven´t returned money to anyone on Vila Verde.
    I am still waiting to try and get them to arbitration, which is the only way to get the money back.

    Hi Guys
    Got an email from A&M and they claim that they have negotiated with Tecnicil the following:-
    1. Downsize and complete
    2. Moneyback without interest to be paid by end of 2011
    3. Arbitration to get back at least all money paid and interest and going upto double money back
    Tecnicil have appointed an arbitrator – has anyone else been asked to go ahead with arbitration proceedings?
    The process is at least 3 months and certainly not years as has been said on other forums.

    Hi Sparky,
    I´ve been told that this is going to long and could take from 6months to 1 year.
    Personally, I believe that most of the lawyers are in bed with Tecnicil but as you state, the contract is quite clear and there´s no doubt that they don´t have a leg to stand on, which is why no one has yet taken them to arbitration.
    All deals I believe are off and that they were laying these down just to see how many people are willing to cancel their contracts. Obviously, they worked out the figures and don´t want to pay anyone back now!

    Arbitration is a completely new process for CV in terms of settling a dispute with a property development. If you have been told that it isn´t you´re being lied to.
    Tecnicil told me that I had absolutely no chance of winning in Arbitration because they claimed FM and it was approved by the local government.
    Tecnicil do not want people to go to Arbitration because of the expense, hence they offered people their deposit minus 15% before Christmas to MRI clients – this is the same costs as Arbitration and this is not a coincidence!
    Most lawyers seem to personally know the Tecnicil lawyer and is something you should bear in mind.
    However, they all say their independent!
    Not sure if a group case is the way to go beacuse of the different phases on VV – it does mean that everyone´s situation is different and all the lawyers I feel will charge you the same whether it group or individual actions.

    Hi Guys, most solicitors are saying 5% for representing you and in total with court fees and arbitrator costs you´ll be looking at 15% of the value of the case – this could be the cost of the apartment or the claim. It depends on which solicitor you speak with.
    Bear in mind that all of the solicitors are slow – it´s not the UK and communication is very poor in general!
    Finally, if you read the contract and consult with your lawyer, you can ONLY go to ARBITRATION. There is no remedy to go to court. This has been talked about a lot in the forum and it´s plainly incorrect – you need to speak with a CV lawyer because only a CV lawyer can represent you only you want to pay for accomodation expenses etc.
    as MMichie said it would be better to find out how many on the forum are going to Arbitration and which phase their are in.

    My lawyer has told me that Tecnicil have no intention of giving money back even if they lose arbitration. If you want the money you have to take them to court. Has anyone else been told this by their lawyers?

    I have had no answer from Tecnicil but to say that I must pay for the last instalment or be in default i.e. breach of contract. This is despite sending them a letter advising in April that I would not complete and that they were in breach of contract i.e. late delivery and that Force Majore did not exist.
    I intend taking them to arbitration.
    Is anyone else starting arbitration proceedings?

    Hi bubble, the only thing is that he doesn´t speak English only Portuguese. I can give you his details if this isn´t a problem.
    I´ve been told also that you´re not supposed to put email addresses on this forum, so how do we get around this issue?

    Hello Enterado,

    I got a local engineer recommended by my lawyer to do the inspection.
    As I´m not an engineer, I don´t think I would have picked up on all the detail which he did. All the common areas have yet to be completed in and outside the building.
    In any case, as none of the services are connected another inspection has to be done.
    You need to check with the snaggers as to how many visits they will do – some charge if they need to go back more than 3 times!
    I asked for and received fotos of all the problems.

    Thanks for your comments Peter, but having a huge hole in the kitchen ceiling is not acceptable. All of the interior walls will have to be painted because of patches clearly visible on the surface.
    Also, if you cannot check the water and electric installations because they are not finished or connected, what good is that to you?
    Uneven surfaces is another issue.
    So while everything may seem rosey for you, I don´t see it that way.
    Please remember that this was given as completed. Anyone who didn´t organise their snagging, will now not have the opportunity to get these things fixed by Tecnicil. Do you think that it is acceptable?
    As an aside, I received a call by the snagging service related to Tecnicil on Friday, asking if I wanted to use them. That´s fine but they got my mobile number from Tecnicil without my permission or taking into accoun that the snagging was done almost 2 weeks ago.

    I have bought in Sedum and the snagging shows that the work is second rate. I have a huge hole in the kitchen where the extraction fan goes, the wardrobe in the bedroom doesn´t shut, silicone is missing from the work tops, there´s no water or electric and the windows have not been completed properly. Basically, this is not what snagging is all about. Tecnicil either have no QA Department or they expect people to put up with anything. These are not minor problems. Maybe because it´s on the top floor they couldn´t be bothered to complete it properly.
